Institutional verification

Certain personal details are omitted from the public pages of onlyivan.com and are described rather than stated. The omission is a protective measure. The particulars that establish an educational record are the same particulars used to verify identity when opening an account or recovering one, and a public page is retrieved by automated collection systems far more often than by readers. Publishing them would place them beyond recall.

An institution assessing an application, a candidacy or a reference has a legitimate interest in the omitted particulars. This page sets out the terms on which they are released to such an institution, and applies to every person who requests or is granted access.

• Operator means Ivan Semenenko, who controls onlyivan.com and determines every question of access under these terms.
• Withheld Information means the particulars omitted from the public pages, being the institutions of education attended and the examination results in full, together with the credential reference numbers of the certifications listed on the site.
• Institutional Address means an electronic mail address administered by an educational, governmental, professional or corporate body, at a domain controlled by that body.
• Requesting Person means the named individual submitting a request.
• Access Credential means the single link issued upon approval.
• Access Period means thirty days from issue, after which the Access Credential ceases to operate.

A request is admissible only where it is submitted from an Institutional Address. An address administered by a consumer mail provider, or by a service offering temporary or disposable addresses, is not admissible and is refused at the point of submission.

The requirement is evidential rather than administrative. An address that any person may create on demand establishes nothing as to who holds it. An address at a domain controlled by an institution establishes that the institution has issued it, which is the fact relied upon.

The Requesting Person warrants that the address submitted is their own, that it is issued to them by the institution named, and that the role stated is the role they hold.

Each request is considered individually by the Operator. No request is granted automatically, and eligibility under clause 03 confers no entitlement to access.

The Operator may grant, refuse or defer a request at discretion, is not obliged to give reasons for a refusal, and may impose a shorter Access Period in any particular case.

Approval issues one Access Credential to the Institutional Address given in the request and to no other address. It is bound to that address, is personal to the Requesting Person, and is not transferable.

Disclosure of the Access Credential to any other person, whether within the same institution or otherwise, is a breach of these terms. A colleague requiring access submits their own request.

Access subsists for the Access Period and then lapses by operation of the credential itself, without further act by either party and without notice. The Operator may in addition withdraw access at any time, and does not undertake to give reasons or notice for doing so.

The Withheld Information is released for the sole purpose of verifying the record in connection with an application, a candidacy or a reference under consideration by the institution named in the request.

Access does not authorise, and the Requesting Person shall not:

• disclose the Withheld Information to any person other than those within the named institution who require it for that purpose;
• retain the Withheld Information beyond the period for which it is required for that purpose;
• reproduce, publish, transmit or index the Withheld Information, or incorporate it into any dataset, register or model; or
• use the Withheld Information for any commercial purpose whatsoever.

The Withheld Information is confidential and is released in confidence. The Requesting Person shall keep it confidential, shall apply to it no lesser standard of care than that applied to comparable personal data held by their institution, and shall not permit access to it by any person not entitled to it under clause 07. This obligation survives the lapse of access.

The particulars submitted in a request, being the name, Institutional Address, institution, role and stated reason of the Requesting Person, are treated as confidential by the Operator.

They are:

• read only by the Operator;
• used only to decide the request and to deliver the Access Credential;
• never published, displayed on the site, transferred, disclosed, sold, licensed, or made available for advertising or any other secondary purpose; and
• never used to initiate correspondence unconnected with the request.

Correspondence between the Operator and the Requesting Person arising from a request is likewise treated as confidential by the Operator and is not published.

The Operator is the controller of the particulars described in clause 09 for the purposes of the United Kingdom General Data Protection Regulation and the Data Protection Act 2018. The lawful basis for processing them is legitimate interests, namely the operation of a controlled disclosure mechanism, which is the interest of both parties and could not be achieved without recording who has asked and what was decided.

Records of requests and decisions are retained for so long as is necessary to administer access and to maintain an account of what has been disclosed and to whom, and are then erased. A Requesting Person may request access to, rectification of, or erasure of their particulars, and may object to the processing, by writing to contact@onlyivan.com. A complaint may be made to the Information Commissioner's Office.

The general privacy policy applies to this page in all other respects.

The Requesting Person shall not forward the Access Credential, shall not store it in a shared or unsecured location, shall end the session when using a shared device, and shall notify the Operator without delay at contact@onlyivan.com if the credential is disclosed, lost, or comes into the possession of any other person.

The Withheld Information is provided in good faith and is stated to be accurate to the best of the Operator's knowledge at the date of disclosure. It is a statement of record made by the individual concerned. It is not certified by, and is not issued on behalf of, any institution, examining body or awarding organisation.

Where an institution requires a certified record, it should obtain it from the awarding body directly. The certificates, transcript and letter of reference published on the achievements page are reproduced as issued and require no approval to read.

The Operator accepts no liability for any decision taken, or not taken, by any person in reliance on the Withheld Information, nor for any loss arising from the unavailability, lapse or withdrawal of access. Nothing in this clause limits liability for fraud, for fraudulent misrepresentation, or for any other liability that cannot lawfully be limited. The disclaimer applies in full.

Where the Operator has reasonable grounds to believe that these terms have been breached, access may be withdrawn immediately and without notice, further requests from the person or the institution concerned may be refused, and the Operator reserves every remedy available in law, including in respect of the confidence in which the Withheld Information is released.

These terms may be varied at any time, and the version in force is the version published on this page at the time a request is submitted. They are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction in respect of them.
